Shopify v EUIPO: the case on the root "SHOP".
I analyzed the dispute at the software level, preparing the technical documentation for the USPTO and working out with legal counsel, who then argued it before the EUIPO, the position on the genericness of the root "SHOP". The General Court of the European Union (Case T-222/21) dismissed Shopify’s action, finding no likelihood of confusion.
